The nomination must be approved before (or alongside) the visa application.

Nominations are commonly refused due to incorrect occupation selection, salary not meeting AMSR requirements, weak evidence of a genuine role, or incomplete documentation. Issues with labour market testing, sponsor compliance history, or unclear business need can also lead to refusal.
No. A nominee does not need to be currently employed by your business at the time of nomination. However, you must demonstrate that the role is available and that you genuinely intend to employ the nominee under the terms stated once the visa is granted.
Any significant change to job duties, salary, or employment terms after approval may require a new nomination or notification to the Department. Employers are expected to employ the nominee in the role and conditions approved in the nomination to remain compliant with sponsorship obligations.
Nomination validity depends on the visa subclass. Generally, nominations remain valid for a limited period after approval, during which the visa application must be lodged or decided. If the nomination expires before visa grant, a new nomination may be required.
